"Renovation and Relocation" Problems at Shuizuogang
南京水佐岗32号21幢、22幢建于上世纪50年代,2001年被南京市房屋安全鉴定中心认定为“危房”,为此,产权单位南京三乐电气公司从三年前就得到南京市政府、房管办、拆迁办等部门的批准,开始实行集资建房,可时至今日不但新房没有建好,就连危房的拆迁工作也因39名承租户中的6户住户反对而停滞不前。就此事,记者进行了调查了解。
Buildings #21 and #22 of Nanjing City's Shuizuogang No. 32 were built in the 1950's. They were determined to be "dangerous buildings" by the Nanjing City Building Safety Authorization Center in 2001. Therefore, three years ago, the owner, Nanjing Sanle Electric Company, received approval from the Nanjing City government, the City Housing Management Office and the Renovation and Relocation Office, to start raising funds to build new houses. To this point, not only have the new houses not been finished, even the tearing down of the dangerous houses and the relocation of the tenants have stopped because 6 of the 39 tenants are against it. This reporter investigated this matter.
周大爷和老伴自从2002年就因产权单位的集资建房而搬到了其他地方去住,所住的过渡房每月要花五六百元的租金,虽然说产权单位会按规定给予一定补偿,但长期无家可归和“高昂”的租金,还是让周大爷对迟迟不愿搬迁的6户住户产生了不满,周大爷认为,就是因为这6户贪图“私利”,而耽误了大部分住户住进新房。
Mr. Zhou and his wife were moved to another place to live in 2002 due to the new construction. The transitional housing where they now live costs 500-600 RMB in rent per month. Although the owner of the old house will give some compensation as required, long-term "homelessness" and "expensive" rent make Mr. Zhou unhappy with the 6 families who do not want to move out. He thinks that just because these 6 families are selfish, they delayed most families' moving into new houses.
水佐岗32号21幢102室的李先生告诉记者,80年代的时候,房屋曾经要拆建新房,那时候还是福利性分房,可产权单位出于种种原因不答应,现在,产权单位要搞集资建房,每户居民要拿出十几万元出来,可没有考虑到现在他们一家都在拿最低生活保障金过日子,家里还有个儿子上大学,根本就没有能力买房子,对此,产权单位又始终不能拿出个让他们满意的解决方案出来,不满足条件他是不会搬的。
Mr. Li, who lives in room 102, building #21, of Shuizuogang No. 32, tells this reporter that in the 1980's, the houses should have been demolished to build new houses. At that time, houses were still apportioned by welfare allocation. But, the owner disagreed due to some reasons. Now the owner wants to collect money from the families to build houses. Each family needs to pay more than 100 thousand RMB. It is not taken into consideration that they are living on the Minimum Living Subsidy. His family also has a son studying at college. They are not able to buy a new house at all. And the owner never gave them a satisfying plan regarding this problem. He will not move out if his conditions are not satisfied.
南京三乐电气总公司总经理助理王春临称:水佐岗32号21幢、22幢经房屋安全鉴定中心鉴定为危房后,2001年下半年他们开始着手搞集资建房,所有方案、规划都得到南京市政府、房管办、拆迁办等相关部门的批准,但部分居民提出不符合房改相关政策的要求,他们不能接受,所以一直拖到现在。
Chunlin Wang, Assistant CEO of Nanjing Sanle Electric Company, said that after Buildings #21 and #22 of Shuizuogang No. 32 were determined to be "dangerous buildings" by the Nanjing City Building Safety Authorization Center, they [the company] started to raise funds to build new houses in the second half of 2001. All plans were authorized by the Nanjing city government, the Building Management Office and the Renovation and Relocation Office. But some of the residents submitted requirements that were not in accordance with the housing development policy. They cannot accept them. Therefore the issue has been delayed until now.
江苏致邦律师事务所高级律师唐伟认为,租赁者应尊重,服从产权单位的合法处理,双方协调不成的情况下,产权单位可以主张、实现自己的合法权益。
Superior Lawyer Wei Tang of Jiangsu Zhibang Law Office thinks that tenants should respect and obey the owner's lawful management. If the two parties cannot come to terms, the owner may take steps to assert his legal rights.
